OF PUBLIC LOCAL INQUIRY TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997 THE LANDS AND ESTATE OF RODEL, INCLUDING THE, RODEL CROFTS, COMMON PASTURE AND COW PARK AND THE ISLANDS OF GILSAY, LINGARABAY AND VALLEY AND OTHER SMALL ISLANDS OR ROCKS ADJOINING AND PERTAINING TO THE LANDS AND ESTATE OF RODEL TOGETHER WITH THE FORESHORE OF THESE LANDS AND OTHERS IN SOUTH HARRIS, WESTERN ISLES Scottish Ministers have appointed Mr J M MeCulloch BA(Hons) MRTPI and Mr R W Jackson LLB to hold a public local inquiry and to report to them in connection with the mineral planning permission appeal in respect of the above land. Scottish Ministers have indicated that the only matters to be examined at the public local inquiry are whether there was ever a vah.d mineral planning permission issued in 1965 and; if so. whether development work took place that would be sufficient to enable any such permission to remain extant. There should be no e.vamination at the inquiry of the merits of the development or of any wider planning and environinental issues that it mieht be held to raise. The inquiry will be held in public. Any party wishing to take part in the inquiry proceedings should contact the Scottish Executive Inquiry Reporters Unit immediately. if they have not already done so. Those participating in the inquiry by leading oral evidence were expected to have provided a statement indicating the terms of the caseI that they propose to make by l6thAugust: any necessary documents in support of that case should be circulated by 29th October and witness precogoitions. together with any necessary summary precogoitions, legal authorities and case law should be circulated by 12th November Additional written submissions from any party choosing not to lead oral evidence at the inquiry should be circulated before 12th November. The inquiry will commence at 2pm on Monday 26th November 200l within the Anchorage Restaurant The Pier. Leverburgh. The inquiry will continue on successive days and will run until 2pm on Friday 7th December 2001. The inquiriy will re-convene at 10:00am on Wednesday 5th December 2001 in the samel venue to hear parties' closing submissions. It is expected that these will be concluded on or before Friday 7th December 2O01. You may wish to note that this venue has access suitable ftor the disabled, Copies of the inquiriy documents will be available for inspection by interested parties at An Clachan. Leverburgh. Isle of Harris from 29th October 001 and witnesses precognitions, including summaries where appropriate. Iegal authorities and case law will be available for inspection from 12th November 2001.
